Determining If Probate Is Necessary

We’re discussing probate, a legal process that often follows someone’s death. Many folks are unsure if their loved one’s estate even requires going through probate. Can you shed some light on how families can determine if this step is necessary?

Probate: A Necessary Step for Some

Certainly. The first thing we look at is the value of the deceased person’s estate. In California, estates valued at $184,500 or less are generally exempt from probate. Consequently, if the total worth of assets falls below this threshold, a simpler process like transferring ownership through an affidavit might suffice. However, if the estate exceeds this amount, probate becomes necessary.

It’s also crucial to identify any assets that pass outside of probate. Assets held in trusts, jointly owned property, or accounts with beneficiary designations typically bypass probate altogether. These are called non-probate assets. Conversely, assets solely in the decedent’s name, like bank accounts or real estate, will likely require probate.

Notwithstanding these guidelines, each situation is unique. I always recommend a consultation to carefully assess the specifics of an individual’s estate and determine the best course of action.

Challenges in Determining Probate Necessity

I recall a case where a family was convinced their mother’s estate wouldn’t require probate because it seemed small. However, after a thorough review, we discovered she had a significant life insurance policy that hadn’t been disclosed. Ultimately, the estate value exceeded the threshold, and we needed to initiate probate proceedings.
