Certainly. Filing the petition for probate is the crucial first step initiating the entire process. It formally notifies the court that an individual has passed away and that their estate requires administration. The petition, specifically Form DE-111 in California, outlines key information about the deceased, including their name, date of death, residence, and assets. Moreover, it requests the appointment of an executor or administrator to manage the estate.

Submitting the original will, if one exists, is also a vital part of this step. The will dictates how the deceased wanted their assets distributed. Without a valid will, state intestacy laws determine asset distribution, which may not align with the decedent’s wishes. Consequently, having a clear and legally sound will is paramount for ensuring that an individual’s final wishes are respected.
