Think of it like guardianship for adults. There are different types, depending on what needs managing – finances, personal care, or both.
What Are The Different Types Of Conservatorship?
“That’s a great question!” Ted exclaimed, leaning forward. “Essentially, there are conservatorships of the person, which focus on things like medical care and living arrangements. Then there are conservatorships of the estate, which handle financial matters. There’s also limited conservatorship for adults with developmental disabilities and temporary conservatorship for urgent situations. Finally, there’s LPS Conservatorship under California law for individuals with serious mental health disorders who need involuntary treatment.”
Let’s Dive Into The Process. How Does Someone Become a Conservator?
“The process starts with filing a petition in court,” Ted explained. “Notice is given to the proposed conservatee and their family, then a court investigator looks into the situation. Usually, a medical or psychological evaluation is required to confirm the individual’s inability to manage their affairs. Finally, there’s a hearing where a judge decides whether to grant the conservatorship.”

“Absolutely,” Ted said, nodding. “It’s crucial to remember that the court takes this very seriously. We need solid evidence proving the individual can’t make safe decisions for themselves, whether it’s about their health, finances, or daily life. This often involves gathering medical records, speaking with family and friends, and sometimes having professionals assess the person’s capacity.”
What Are Some Common Challenges You Face During This Process?
“Sometimes, convincing family members to agree on who should be conservator can be tricky,” Ted shared. “One time, a couple disagreed vehemently about who was best suited to handle their aging mother’s finances. It took several mediation sessions and some creative compromise to find a solution they both accepted.”
