Ah, a fantastic question, Beatrice. Step H is often underestimated, but it’s absolutely critical. You can have the most meticulously crafted estate plan in the world, but if your loved ones can’t find the documents when they need them, it’s all for naught. The goal is to create a system that is both secure and accessible. I always advise clients to keep the originals of their core documents – the will, the trust, the power of attorney, and the advance healthcare directive – in a secure yet accessible location. A fireproof safe is a good option, but it’s not enough on its own. Consider a safe deposit box at a bank, but be aware that accessing it after your death can sometimes be delayed due to legal requirements.

A more practical approach is to store the documents in a designated location at home – perhaps a filing cabinet in a home office – and then make copies available to your executor and attorney. It’s also wise to create a digital backup of all your documents and store it securely in the cloud. This ensures that they’re protected in case of a fire, flood, or other disaster. But don’t just store the documents; create an inventory. A simple list of all your estate planning documents, along with their location, is invaluable. This inventory should be shared with your executor and attorney as well. We’ve had situations where clients have passed away without their loved ones knowing the existence of certain accounts or assets, simply because the information wasn’t readily available.

About Estate Planning Law – Ted Cook

Ted enjoys working with clients to create a custom estate plan to protect their assets and to make sure their wishes are reflected in their estate plan. He treats each client as an individual and takes pride in the level of service he provides.

Ted graduated from the U.S. Air Force Academy and was commissioned an Ensign in the U.S. Navy. In the Navy, he was a Surface Warfare Officer and served on three ships on the West Coast. While in the Navy, Ted attended the University of San Diego School of Law where he received his Juris Doctrate degree in 1989. After law school, Ted continued his active duty service in the Navy as a Judge Advocate General Corps officer. After retiring from the Navy in 2011, Ted became a partner with Tom Henry in the law firm of Henry & Cook, LLP focusing on estate planning. Upon the passing of Tom Henry in 2022, Ted started his own firm and continues to help his clients create estate plans that are individually tailored to meet their needs.
