Interview with Steve Bliss on Trusts

Hello and welcome back to Wildomar Today! I’m your host Brenda Newsome, here today with Steve Bliss of Wildomar Probate Law. Steve, thanks so much for joining me.

Understanding the Importance of Trusts

Steve, for our viewers who may not be familiar with trusts, could you explain why they are such an important part of estate planning?

“Absolutely Brenda. Trusts are incredibly valuable tools that allow individuals to manage and distribute their assets in a controlled and efficient manner, both during their lifetime and after their passing. Essentially, a trust is a legal entity that holds assets for the benefit of designated beneficiaries. By placing assets into a trust, individuals can avoid the costly and time-consuming process of probate, maintain privacy regarding their financial affairs, and ensure their wishes are carried out precisely.”

Choosing the Right Type of Trust

That’s fantastic information, Steve. Now there are various types of trusts available. Could you elaborate on one type that might be particularly beneficial for our viewers?

“Certainly. Today, I’d like to discuss Revocable Living Trusts. These are among the most common trusts used in estate planning. A revocable living trust allows the grantor, the person who creates the trust, to maintain full control over their assets during their lifetime. They can make changes to the trust terms, add or remove beneficiaries, or even dissolve the trust altogether if circumstances change.”

“Moreover, upon the grantor’s death, the trust becomes irrevocable, meaning its terms cannot be altered. The assets held within the trust are then distributed according to the grantor’s wishes, bypassing probate entirely. Consequently, this process can save beneficiaries time and expense while ensuring a smooth transition of assets.”

“The beauty of a revocable living trust lies in its flexibility. You can adjust it as your life evolves, accommodating changes in family dynamics, financial circumstances, or personal goals. Ordinarily, I advise clients to review their trusts every few years to ensure they still align with their intentions.”

Navigating Challenges and Success Stories

Steve, are there any common challenges you encounter when setting up Revocable Living Trusts for clients?

“While revocable living trusts are generally straightforward, we occasionally encounter situations where clients haven’t thoroughly considered the distribution of their assets. For instance, I once worked with a couple who had accumulated significant wealth over the years but hadn’t clearly defined how they wanted to divide it among their children and grandchildren.

Through careful discussion and exploration of their values and priorities, we were able to craft a trust agreement that reflected their wishes and minimized potential family disputes down the line. It was incredibly rewarding to see them find peace of mind knowing their legacy would be handled according to their desires.”

“In another case, a single client had complex financial holdings across multiple states. Coordinating the execution and registration of the trust in each jurisdiction required meticulous attention to detail. Nevertheless, we successfully navigated the legal complexities, ensuring the client’s assets were properly protected and managed according to their wishes.”

“According to the American Bar Association, over 50% of Americans don’t have a will or any estate planning documents in place. This statistic underscores the crucial need for individuals to proactively address their future financial well-being and protect their loved ones.”

Embracing Security and Peace of Mind

“Steve, what advice would you give our viewers who are considering setting up a Revocable Living Trust?”

“My primary advice is to consult with an experienced estate planning attorney. An attorney can assess your individual circumstances, explain the different types of trusts available, and guide you through the process of creating a trust that meets your specific needs. Remember, a well-crafted trust can provide peace of mind, knowing that your assets are protected and will be distributed according to your wishes.”
