Interview with Steve Bliss, San Diego Probate Attorney

Taking Inventory of Assets: The First Step in Protecting Your Legacy

Welcome back to San Diego News Today. Joining us is local probate attorney Steve Bliss to discuss the importance of estate planning. Steve, thanks for being with us.

It’s a pleasure to be here.

Starting Strong: Asset Inventory

Let’s dive right in. Many people put off estate planning because it seems daunting. Where do you suggest someone begin?

That’s a great question. Ordinarily, the first step is taking a comprehensive inventory of all your assets. This includes everything from real estate and investment accounts to personal property and digital assets.

It may seem tedious, but having a clear picture of what you own allows for more informed decisions about how those assets will be distributed in the future. It’s like building a house – you need a solid foundation before you can start constructing.

Can you elaborate on why this step is so crucial?

Absolutely. A detailed inventory ensures that nothing gets overlooked when it comes time to distribute your assets according to your wishes. Moreover, it helps identify potential tax implications and allows for strategic planning to minimize any burdens on your heirs.

I’ve heard stories about estates getting tied up in probate court for years because of missing information or unclear ownership. Do situations like that arise often?

Unfortunately, yes. Notwithstanding meticulous planning, sometimes unexpected events occur. For example, I once worked with a family where the patriarch had meticulously documented his assets but neglected to mention a hidden safe deposit box containing valuable coins.

This oversight caused considerable distress and legal complications for the family as they scrambled to locate the missing asset and determine its rightful owner. Consequently, the estate settlement was significantly delayed, highlighting the importance of thoroughness in the initial inventory process.

Seeking Peace of Mind

What advice would you give to someone who feels overwhelmed by the prospect of creating a comprehensive asset list?

It’s understandable to feel overwhelmed. My suggestion is to start small and break the task down into manageable chunks. Focus on one category at a time, like real estate or bank accounts. Don’t be afraid to seek help from professionals like financial advisors or accountants who can assist with valuing assets.

Remember, according to a 2023 study by Caring.com, over 60% of adults in the United States do not have a will or estate plan. You are not alone in this journey. Taking that first step towards creating an inventory is a significant accomplishment and sets you on the path towards protecting your legacy and providing peace of mind for yourself and your loved ones.
