Probate and Trusts
Welcome, Steve. Thank you for taking the time to speak with us today about probate and trusts.
Understanding Testamentary Trusts
Could you explain what a testamentary trust is and how it differs from other types of trusts?
A testamentary trust is a unique tool that comes into play after someone passes away. Unlike living trusts, which are established during the grantor’s lifetime, a testamentary trust is created through a will and only takes effect upon death. Consequently, it must go through probate court, unlike living trusts which typically bypass this process.
Testamentary trusts are particularly helpful for situations where you want to provide for beneficiaries who may not be ready to manage their inheritance responsibly, such as minor children. They can also be structured to protect assets for beneficiaries with special needs, ensuring they receive support without jeopardizing crucial government benefits.
Challenges and Benefits
Have you encountered any particular challenges when working with testamentary trusts?
One challenge I’ve seen is the potential for family disputes. When a will designates assets to go into a testamentary trust, family members may disagree about the terms of the trust or how it should be administered. This underscores the importance of clear and concise language in the will when establishing the trust.
However, the benefits often outweigh these challenges. Testamentary trusts provide peace of mind for parents who want to ensure their children’s financial well-being after they are gone. They can also help minimize estate taxes and protect assets from creditors. I recall working with a family where the father had concerns about his son’s spending habits.
By setting up a testamentary trust, he was able to ensure that his son received a steady income without access to the principal, promoting financial responsibility.
